Milwaukee Brewers owner Mark Attanasio found himself in a sand scandal on Malibu beach after being accused of digging up the beach for his private mansion. Neighbor James Kohlberg, the son of Jerome Kohlberg Jr., one of the founders of the private equity firm Kohlberg Kravis Roberts & Co., filed the lawsuit.
The lawsuit, which was acquired by the Los Angeles Times, alleges that Attanasio has been extracting sand from Broad Beach in Malibu for his personal use on his own land. “This case is about a private property owner using a public beach as their own personal sandbox and the disturbing conversion of a public natural resource (i.e., sand from Broad Beach) for a nearby homeowner’s personal, private use,” the suit claims.
According to Yahoo News, court papers state Attanasio got a permit to fix a damaged seawall on his multi-million-dollar beach house. The permit prohibits using big machines in the tidal zone and removing sand from the beach. However, pictures shared in the lawsuit show excavators digging up sand right on the shore.
Attanasio has been accused of public nuisance and violating the ‘California Coastal Act.’ The Brewers owner told the LA Times that he and his contractors followed all the rules and complied with the permits. Meanwhile, Kohlberg is seeking financial penalties against Attanasio and a court order mandating the replacement of the removed sand.
The topic of public beach access has been widely debated along the California Coast, particularly in locations such as Malibu and Laguna Beach. Last month, a homeowner on Laguna beach engaged in a heated dispute with beach visitors, alleging they were on private property without permission. However, the Coastal Commission affirmed that all beaches are public until the high tide line.
